Terms of Service

1. Acceptance of Terms

By accessing or using the RealHourly service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is intended for users who are at least 14 years old. Users under 14 are prohibited from using the Service.

2. Service Description

RealHourly provides an AI-powered profitability dashboard for freelancers and independent contractors. Key features include:

• Natural language processing-based time logging with voice input
• Real hourly rate calculation accounting for hidden costs
• Scope creep detection and AI-generated billing message generation
• Profitability analysis and dashboard
• Weekly reports and AI insights
• PDF invoice and estimate generation
• Client work report sharing

We reserve the right to modify, suspend, or discontinue the Service's features, pricing, or availability at any time without prior notice.

3. Accounts and Registration

To use the Service, you must create an account through Supabase. When creating an account:

• You must provide accurate, complete, and current information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use or security breach

We reserve the right to refuse account registration or terminate existing accounts at our sole discretion.

4. Subscriptions and Billing

4.1 Pricing Plans

• Free Plan: Basic features with limited projects
• Pro Plan ($9/month): Unlimited projects, AI insights, priority support

4.2 Payment Processing

All subscription payments are processed through Polar. By subscribing to the Pro Plan, you agree that:

• Monthly subscription fees will be charged automatically
• You are responsible for maintaining sufficient funds in your payment method
• Failed payments may result in service suspension or termination
• All fees are stated in United States Dollars (USD)

4.3 Refund Policy

Subscription fees are non-refundable. If you cancel mid-billing cycle, you will retain access to the Service until the end of the current billing period, but you will not be charged for the next cycle.

4.4 Price Changes

We reserve the right to change subscription pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Intellectual Property

The Service and its original content, features, and functionality are the exclusive property of RealHourly and its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, sell, or lease any part of the Service's source code
• Reverse engineer, decompile, or disassemble the Service
• Use our trademarks, logos, or branding without authorization
• Create derivative works based on the Service

6. User Content

You retain ownership of all data and content you upload or enter into the Service (project information, time entries, cost entries, etc.).

By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service to you
• Use your content to generate AI-powered analytics and insights
• Use data in anonymized and aggregated form for service improvement analytics

We do not sell or share your personal data with third parties. See our Privacy Policy for details on data processing.

7. Prohibited Use

When using the Service, you must not:

• Use the Service for any illegal or fraudulent purpose
• Attempt to bypass or disable any security features of the Service
• Use automated systems (bots, scrapers) to access the Service without authorization
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to other users' accounts
• Overload the Service infrastructure or interfere with other users' access
• Upload or share content that infringes on our or others' intellectual property rights
• Post illegal, threatening, defamatory, obscene, or otherwise objectionable content

8. Disclaimers and Limitation of Liability

8.1 As-Is Service

The Service is provided "as is" and "as available" without warranties of any kind, including but not limited to:

• Warranties that the Service will operate uninterrupted, securely, or error-free
• Warranties that calculation results are 100% accurate
• Warranties that the Service meets your specific requirements

8.2 No Professional Advice

IMPORTANT: RealHourly does not provide financial, tax, legal, or accounting advice. All calculations and insights provided by the Service are for informational purposes only and do not constitute professional advice.

Before making important financial decisions such as salary calculations, tax filings, or contract negotiations, consult with a qualified accountant, tax professional, or legal advisor.

8.3 Limitation of Liability

To the maximum extent permitted by applicable law, RealHourly shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages (including data loss, revenue loss, business interruption, etc.)
• Direct damages arising from use or inability to use the Service (our maximum liability is limited to the amount you paid in the last 12 months)
• Third-party service failures or interruptions (Supabase, Polar, OpenAI)
• Financial losses due to calculation errors, data loss, or security breaches

9. Data Security

We use industry-standard security measures to protect your data, but we cannot guarantee that transmission over the Internet or electronic storage methods are 100% secure.

Your responsibilities:

• Use strong passwords and change them regularly
• Do not share your account credentials with others
• Regularly back up important data (Settings > Export Data)

10. Termination

10.1 Termination by You

You may cancel your subscription and delete your account at any time from account settings. Upon account deletion, all data will be permanently deleted within 30 days.

10.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• Payment fails or fraudulent activity is suspected
• Your account is inactive for an extended period (12+ months)
• Legal requirements or government orders require it

Upon termination, no refund will be provided for the current billing cycle and all data access will be immediately revoked.

11. Changes to Terms

We may modify these Terms at any time at our sole discretion. For significant changes:

• We will notify you by email at least 30 days in advance
• We will update the "Last Updated" date at the top of this page and post a notice on the Service

Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

12. Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of the Republic of Korea. Any disputes arising from these Terms or the Service shall:

• First be attempted to be resolved through negotiation with us (contact below)
• If negotiation fails, be subject to the exclusive jurisdiction of the courts of Seoul, Republic of Korea

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and RealHourly regarding your use of the Service and supersede all prior oral or written agreements.

13.2 Severability

If any provision of these Terms is deemed unenforceable, that provision shall be modified to the extent enforceable or deleted, and the remaining provisions shall remain in full effect.

13.3 No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 No Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may freely assign these Terms.
